1. Definitions
The accident scenes: the first location of the accident for the insured vehicle before being moved to different location following police officer orders.
Motor surveyor: in-house motor surveyor of Direct Asia Services (Thailand) or employees of outsourcing survey companies that Direct Asia Services (Thailand) provide services for the insured vehicle.
The Insured: the person named as the insured in the policy schedule
The incident driver: the driver named in the Value Plan policy or the authorised driver as indicated as able to drive an insured vehicle of Value Plus Plan and Flexible Plan policies. This does not include any parties who are involved in the seizure of the insured vehicle or guilty of burglary, robbery, theft, embezzlement.
Fresh claim: claim that is occurred immediately after incidents that occurred during the period of insurance caused by the collision of the insured car and parties’ car or any vehicles that can identify the parties. This does not include appointments or follow-up case after accident occurred.
2. The claimant
Condition of this service is for the policyholder / the Insured / incident driver of insured vehicle only.
3. Time
3.1 Time guarantee counting will start at the time of the notification call, received by Direct Asia Services (Thailand) or outsourcing hot line company used by Direct Asia Services (Thailand) and is completed when the motor surveyor arrives at the accident scene.
3.2 Direct Asia Services (Thailand) will consider the 30 minutes guarantee to accident scene by the following documents.
3.2.1 First notification of Loss Report by Direct Asia Services (Thailand) or outsourcing hot line company that Direct Asia Services (Thailand) provide service for insured vehicle.
3.2.2 Motor Survey Report by in-house motor surveyor of Direct Asia Services (Thailand) or employees of outsourcing survey companies that Direct Asia Services provide services for the insured vehicle.
3.2.3 Form of arrival time to accident scene that the policyholder / Insured / Incident driver of insured vehicle sign confirmation as correct.
Note: If there is any dispute, Direct Asia Services (Thailand) will reserve the right to consider solely at their discretion. The policyholder / The Insured / Incident driver of insured vehicle can reserve their own right by requesting an original or copy of the arrival time form from motor surveyor.
4. Location
Direct Asia Services (Thailand) will consider the accident scene of this guarantee in Bangkok and all Amphor Muang of Thailand ( Started on 15 July 2013) . If there is any dispute, Direct Asia Services (Thailand) will reserve the right to consider the case at their discretion.
5. Petrol e-voucher delivery
Direct Asia Services (Thailand) Co., Ltd. will dispatch a petrol e-voucher valued at 1,000 baht within 90 days via SMS to the mobile number registered for the Insured in the system, following verification according to the terms and conditions. The company will provide advance notification to the Insured through either phone or email.
Note: The Insured can exercise their right to claim within 1 year from the date of the incident. The company reserves the right to withhold the replacement e-voucher if the insured does not exercise their rights within the specified period.
6. Exception
The time guarantee shall not be applicable in cases of natural disasters such as flood, earthquake, hail, windstorm and the area was declared a national disaster.Also not applicable to cases which the motor surveyor ( Motorcycle) is restricted or denied access to the accident scene by law or for reasonable causes, such as on expressways where Highway Police have sole jurisdiction, restricted government or private property, or other locations with no possible access to the location.
7. Applicable Law
The use of this program and construing of these Terms and Conditions shall be governed by all applicable laws of the Kingdom of Thailand.
